Working extra hours
If extra hours are necessary, the University of Wuppertal, or persons authorized must approve them. They are subject to the consent of the staff council. Extra hours are generally understood as hours worked outside flexible working hours, i.e. Monday until Friday before 7 am and after 7:30 pm, Saturday or, to a limited extend, Sunday.
In case of extra hours, occupational health and safety regulations must be considered. For employees who clock in everyday, the time recording software MATRIX accounts for these occupational health and safety regulations. However, the respective superior is responsible for ensuring compliance with these regulations.
- After completion of work, employees are obligated to rest for 11 hours before starting work again (para. 5 section 1 Hours of Work Act. ArbZG ). Example: Work is done until 10 pm. The employee may not begin to work before 9 am the following day.
- During working hours, employees must take a break for 30 minutes after 6 hours of work and a 45 minutes break after 9 hours, i.e. additional 15 minutes must be granted.
- Altogether the maximum working time per day is 10 hours + 45 minutes break.
Example: Work starts at 8 am. It has to end at 6:45 pm at the latest. Hours and minutes are automatically capped once the limit of 10 hours + 45 minutes is reached. - Working on Sundays is generally forbidden.
Sunday work can only be permitted in a few exceptional cases which must be defined and justified and are reviewed beforehand by the responsible employees of Section 4.1.1 - Absences. In case of Sunday work, a compensation day must be granted. - Extra hours are credited to the employee’s account in the time recording system Matrix. Here, the limit is a maximum of 60 hours per month.
- Overtime compensation through time off must be given promptly.
